1. Introduction

Snagsta is a list-sharing and social networking service operated by Tower Bridge Consulting Limited ("the Company" or "Snagsta"). This document sets out the Terms & Conditions that apply to the use of the services on the www.snagsta.com domain ("Snagsta"). By using these services you affirm that you accept these Terms & Conditions and agree that your use of Snagsta will be governed by these Terms & Conditions. You should read these Terms & Conditions carefully before using Snagsta as they contain important legal information that may affect your rights.

Snagsta reserves the right at its sole discretion to amend these Terms & Conditions, and will notify you of amendments by posting them on the Terms & Conditions page of the Snagsta site. If you do not accept these Terms & Conditions you should not continue to use the Snagsta service.

It is the responsibility of all Snagsta users, whether members or non-members, to check the Terms & Conditions page of the Snagsta site in order to be aware of any amendments to these Terms & Conditions. By continuing to use the Snagsta service, you affirm that accept any amendments to these Terms & Conditions.

New functions and content may from time to time be added to Snagsta. These will also be subject to these Terms & Conditions unless specifically stated otherwise. Your use of new functions and content indicates your acceptance of the Terms & Conditions that apply to them.

2. Eligibility

In order to use Snagsta you must be over the age of 13. To access certain content and features of Snagsta you must first register as a member and submit the required personal information. Users between the ages of 13 and 18 should have the consent of a parent or guardian before registering as a member of Snagsta. In any event, no person below the age of 13 should register as a member of Snagsta. Snagsta does not solicit personal information from anybody below the age of 13. If you believe that your child who is below the age of 13 has registered with Snagsta and shared their personal information, please contact us.

3. Registration Information & Account Security

As a registered member of Snagsta, you agree to provide accurate and up-to-date information during registration and to keep this information up to date. Failure to provide the required information may result in inability to access certain content and functions, resulting in an incomplete Snagsta experience.

As a registered member of Snagsta, you agree to keep your Snagsta account and login details secure, and to log out promptly at the end of a Snagsta session to help ensure the security of your account. You should notify Snagsta immediately if you believe anyone is using your Snagsta account without authorization. You are responsible for all activity carried out using your account. Snagsta will not be responsible for any losses or damages that occur as a result of unauthorized use of your account. Snagsta respects your privacy and will not share your personal information unless required to by law.

4. Proprietary Rights

Registered members have the ability to post content (e.g. lists) to Snagsta. This content will be made public when you give permission. It is within your control whether or not to make the content you post public. Although you retain copyright in content you post, by posting it you grant Snagsta certain rights for the use of that content.

When you post content that is not to be made public, you grant Snagsta the right to store and aggregate that content and to use it in profile matching and to deliver appropriate search results and recommendations. However the actual content you post will at no time by displayed or made public, it will be used only to establish a relationship; private content will always remain private.

When you choose to make content public, you grant Snagsta the right to make that content public and to display it on the Snagsta site. You also grant other Snagsta users the right to duplicate ("snag") that content, either in part or in whole, and to amend and re-display it. You accept that should you choose to delete content you have made public, any duplicate or amended versions that other users have chosen to snag will not be deleted.

5. Trademarks

The Snagsta name, logo and domain name are protected trademarks and may not be reproduced or used without the written consent of the Company. This includes usage as part of other logos or domain names.

6. User Code of Conduct

Snagsta is a list sharing site and social recommendation site, based on the honestly held opinions submitted by its members in good faith. Although Snagsta does not exercise control of the content posted by members, it does require members to follow a code of conduct. By accessing Snagsta, users agree to abide by the code of conduct set out below.

• Users agree to access Snagsta for non-commercial purposes only.
• Users agree not to post any material that violates the rights of any third party, be it individual or organisation. This includes trademark, copyright, privacy and any other proprietary or personal rights.
• Users agree not to post any content to Snagsta that is abusive, libellous or in any way unlawful, or to use Snagsta for purposes of harassment, defamation or incitement to commit a crime.
• Users agree not to use Snagsta for any of the following purposes:
• To post, store, share or otherwise make available any advertising or promotional offers, whether solicited or unsolicited;
• To post, store, share or otherwise make available any private information about a third party individual or organization;
• To post, store, share or otherwise make available any materials, files or software that contain computer viruses or other forms of malicious code;
• To post, store, share or otherwise make available any materials that could be construed as an incitement to commit a criminal offence, or that contain instructions or information on how to commit a criminal offence or any act that may violate local, national, or international law;
• To collect personal information or member contact details such as email addresses in order to send unsolicited communications such as Spam emails;
• To use Snagsta in a way such as to damage or impair the Snagsta site and service;
• To use automated scripts in order to harvest information contained in Snagsta or to otherwise interact with the service;
• To post, store, share or otherwise make available any content that Snagsta may consider to be defamatory, libellous, abusive, hateful, or in any way unlawful, or that may violates rights of any third party;
• To register for multiple accounts or to register for an account on behalf of any other individual or organization;
• To assume the identity of or impersonate any other individual or organization or to misrepresent their own identity, including age;
• To misrepresent an affiliation with any individual or organization;
• To use or attempt to use any Snagsta account assigned to a third party without authorization;
• To create a false identity.

7. User Content

Users are solely responsible for all content they post to Snagsta. Users may not post content which they do not have permission to post; this includes, but is not limited to, material for which copyright lies with a third party. Snagsta does not accept responsibility for monitoring content posted by users, but reserves the right to do so at its sole discretion. Snagsta may remove any content it chooses if it considers content is in violation of these Terms & Conditions, or for any other reason or without reason

Users may remove the content they post at any time, but it is agreed that snagged versions of user lists may not be removed. Snagsta may retain archived versions of deleted content, but this will not be made available on the website

Snagsta does not endorse any content posted by users and does not make any warranties or representations as to the accuracy or completeness of content posted by users. Snagsta will not be responsible for any losses or damages that result from recommendations made by Snagsta users. Snagsta should not be used as the sole basis for selecting products or services. In the case of certain products and services, including, but not limited to, medical and financial products and services, users should always seek expert advice and should in no circumstances make decisions based solely on information contained in Snagsta.

You agree that by using Snagsta you may be exposed to offensive, indecent or objectionable material and accept that Snagsta bears no responsibility for such material. Users are advised to be careful about the content they post and to ensure that it does not in any way compromise their security, either online or offline. Users are responsible for checking the content and applicability of any lists they snag from other users.

8. Data Storage

Snagsta is not obliged to store content posted by Users, and makes no warranties that such content will not be deleted, either through accidental loss or through deliberate deletion when Snagsta believes that content or User behaviour is in violation of these Terms & Conditions, or for any other reason or for no reason. Users are strongly advised to retain private back-up copies of their own content.

9. Copyright Complaints

Snagsta does not solicit the uploading of any material by Users that infringes the copyright of any third party individual or organization. If you believe any content contained on Snagsta is in violation of copyright, please contact us.

10. Repeat Violation Policy

Snagsta reserves the right to terminate the account of any User who repeatedly violates these Terms & Conditions.

11. Third-Party Websites

Snagsta may contain links to third-party websites and content. The Company is not responsible for the content of these websites, or for their Terms & Conditions or Privacy Policies.

12. User Disputes

Users of Snagsta are solely responsible for all their interactions with other users. Snagsta reserves the right but is not obliged to monitor all disputes between users of the Snagsta service.

14. Disclaimers

Snagsta is not responsible or liable in any manner for any content or material posted by users. Snagsta provides Terms & Conditions and a Code of Conduct for posting materials, however Snagsta does not control content that is posted and is not responsible for any materials posted by users, nor is it responsible for the conduct of users, either online or offline.

Snagsta may occasionally be temporarily unavailable due to site maintenance or for other reasons. Snagsta assumes no responsibility for any error, interruption, omission, defect, deletion or delay in operation or transmission, failure of communication line, theft or destruction or unauthorized access to, or alteration of, user communications. Snagsta is not responsible for any technical malfunction or other problems of any telephone or other communications network or service, computer systems, servers or providers, computer or mobile phone equipment, software, or for failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to the user's or to any third party's computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the Internet and/or in connection with Snagsta, including any Mobile Client software. Under no circumstances will Snagsta be responsible for any loss or damage, including but not limited to any loss or damage to any content posted by users, or personal injury or death, resulting from anyone's use of Snagsta or any content posted on Snagsta or transmitted to users, or any interactions between users, whether online or offline. This clause does not cover the extremely unlikely event of fraud committed by an employee of Snagsta or death or personal injury caused by negligence on the part of Snagsta.

SNAGSTA AND ALL SITE CONTENT ARE PROVIDED "AS-IS" AND THE COMPANY DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. THE COMPANY CANNOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM USE OF SNAGSTA. THE COMPANY DOES NOT REPRESENT OR WARRANT THAT CONTENT OR MATERIALS ON SNAGSTA ARE ACCURATE, COMPLETE, RELIABLE, CURRENT OR ERROR-FREE OR THAT SNAGSTA'S CONTENT AND SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR MALIGNANT CODE. SNAGSTA ADVISES THAT YOU SHOULD EXERCISE CAUTION IN THE USE OF ANY CONTENT AND EMPLOY INDUSTRY-RECOGNIZED SOFTWARE TO DETECT AND QUARANTINE VIRUSES. YOU UNDERSTAND AND AGREE THAT YOU ACCESS CONTENT, MATERIAL AND DATA FROM OR THROUGH SNAGSTA AT YOUR OWN RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR YOUR USE THEREOF AND ANY DAMAGES TO YOUR MOBILE DEVICE OR COMPUTER SYSTEM, LOSS OF DATA OR OTHER HARM OF ANY KIND THAT MAY RESULT.

15. Limitation on Liability

IN NO EVENT WILL SNAGSTA OR ITS DIRECTORS, EMPLOYEES, AGENTS OR REPRESENTATIVES BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING FOR ANY LOST PROFITS OR LOST DATA ARISING FROM YOUR USE OF SNAGSTA AND THE CONTENT SNAGSTA CONTAINS. IF YOU ARE DISSATISFIED WITH THE SNAGSTA SERVICE, OR HAVE ANY ISSUE WITH THESE TERMS & CONDITIONS, YOUR SOLE RECOURSE IS TO DISCONTINUE USING THE SNAGSTA SERVICE.

16. Termination

Snagsta reserves the right to terminate User accounts and delete content for any or no reason.

17. Governing Law

Users agree to be governed by the laws of England and Wales. Users also agree to abide by any applicable laws in their own jurisdictions and to ensure that their use of Snagsta does not contravene any such laws.

18. Indemnity

Users agree to indemnify and hold Snagsta, its subsidiaries and affiliates, and their directors, officers, agents, contractors, partners and employees, from and against all claims and liabilities (including claims by third parties), including costs and expenses (including legal fees), arising out of or in connection with any content posted by Snagsta users, or any content users choose to post or share on or through Snagsta, users' use of Snagsta, conduct in connection with Snagsta or with other users of Snagsta, or any violation of these Terms & Conditions or of any law or the rights of any third party.

19. Other

Your use of Snagsta indicates your acceptance of these Terms & Conditions.
